Terms
These terms govern your use of supplierbrief.com and the Supplier FDA Record ("the service"), run by BOTSIS KOSMAS E.E. (trading as KB Analytics), a limited partnership in Greece, VAT EL801829229, General Commercial Registry (GEMI) 164122303000 ("we", "us"). By using the service you agree to them.
1. What the service is
Supplier Brief compiles records that the U.S. Food and Drug Administration (FDA) publishes about food firms: import alerts, import refusals, inspections, warning letters and compliance actions, and recalls. You can search them for free, see each firm's records on its page, check a list of suppliers, and buy a Supplier FDA Record: a dated PDF of one firm's records for your files.
2. What it is not
- Not FDA. We are not affiliated with or endorsed by the FDA. FDA's own records are the authority.
- Not a safety judgement. The service reports what FDA recorded. It does not say that a firm or a product is safe or unsafe.
- Not your supplier evaluation. A record supports one part of a Foreign Supplier Verification Program evaluation: the supplier's FDA compliance history. Your qualified individual decides whether to approve a supplier, and remains responsible for your program.
- Not complete or instant. FDA updates its sources at different speeds and we refresh them daily to weekly, so a recent action can take some days to appear. Records without an FDA establishment number are linked to firms by name and address, and a link can be wrong; records we could not link with confidence are shown apart and not counted. Check what matters to you against FDA's own pages.
3. Using the site
Searching and reading firm pages is free and needs no account. You agree not to collect the site's content in bulk with automated tools, not to disrupt the service, and not to use it unlawfully. FDA's records are U.S. government works and free to use; our compilation, matching, wording, design and software are ours.
4. Buying a Supplier FDA Record
- Price. $29 per supplier, in U.S. dollars, as shown before you pay. Any sales tax or VAT that applies is shown at checkout. You can add your company's tax ID to the invoice there.
- Payment is taken by Stripe. We never see your card details.
- Delivery. After payment you are taken to your record's page, and its address is on the invoice Stripe sends. You can download the record, rebuilt with FDA's latest data each time, for 30 days. Anyone with that address can download it, so share it only with people you want to.
- Right of withdrawal. The record is digital content delivered as soon as you pay. Before paying you ask for it to be delivered at once and acknowledge that, if you are a consumer in the EU or UK, you then lose the 14-day right of withdrawal.
- Refunds. If the record will not download, or it is about a different firm from the one you bought it for because we linked records wrongly, write to hello@supplierbrief.com within 30 days of paying and we refund it in full. A record that correctly shows FDA's records is not refunded because of what those records say.
5. Corrections
If a firm page links a record to the wrong firm, tell us through the "Tell us" link on that page or at hello@supplierbrief.com. We look at every request and remove links that are wrong. We do not change FDA's records.
6. Liability
The service is provided as it is, and we do not promise it will be uninterrupted or free of errors. To the extent the law allows, we are not liable for indirect or consequential loss, including lost profit, and our total liability for any claim is limited to the greater of what you paid us in the 12 months before the claim and US$100. Nothing here limits liability that cannot lawfully be limited, or your rights as a consumer.
7. Changes
We may change the service and these terms. The version in force when you buy a record applies to that purchase.
8. Law and disputes
These terms are governed by Greek law, and the courts of Athens, Greece, decide disputes, except where mandatory consumer law where you live gives you other rights.
